State Auction Process in Minnesota

Minnesota operates as a tax deed state, where unpaid property taxes and penalties become delinquent on the first business day in January after they are due. On this date, the county treasurer returns the county property tax lists for all real property taxes payable in the previous year to the county auditor. Subsequently, on or before February 15th, the county auditor files a delinquent tax list with the district court. If no objections are made, the court enters a tax judgment against the parcels on the list for the delinquent amounts due.

On the second Monday in May, the county auditor initiates a tax judgment sale by “bidding in for the state” the amount of all delinquent taxes, penalties, costs, and interest due. Essentially, this step sells the property to the state in a tax judgment sale. The state then acquires an interest in each tax-delinquent property, subject to the redemption period.

Following the tax judgment sale to the state, the property owner enters the redemption period, which is usually three years but can vary based on factors such as the property’s use and location. During this period, the owner can pay the delinquent tax amounts to prevent losing the property. For properties located in targeted neighborhoods or meeting specific criteria, the redemption period may be one year. Additionally, for abandoned or vacant properties, the redemption period is reduced to five weeks.

If the property owner fails to pay the delinquent amounts during the redemption period, the property is forfeited to the state. After the forfeiture, the state may opt to sell the home at a public auction to the highest bidder.

Foreclosures in Minnesota

In Minnesota, lenders have the option to foreclose on deeds of trusts or mortgages in default using either a judicial or non-judicial foreclosure process.

  1. Judicial Foreclosure: The judicial process of foreclosure is employed when there is no power of sale present in the mortgage or deed of trust. This process involves the lender filing a lawsuit to obtain a court order for foreclosure. Once the court declares a foreclosure, the property will be auctioned off to the highest bidder.
  1. Non-Judicial Foreclosure: The non-judicial process of foreclosure is utilized when a power of sale clause exists in the mortgage or deed of trust. This clause grants the lender the authority to sell the property to pay off the loan balance in the event of default. The power of sale can be executed by the lender or their representative, often referred to as the trustee. Specific guidelines govern this type of foreclosure process, known as the “Power of Sale Foreclosure Guidelines.”

Power of Sale Foreclosure Guidelines:

For a non-judicial foreclosure to proceed in Minnesota, the following conditions must be met:

– No lawsuit to collect on the mortgage is already underway.

– The mortgage and any assignments of the mortgage to new lenders have been duly recorded.

– A notice has been given eight (8) weeks before the foreclosure on a homestead property.

If all the specified conditions are met, the foreclosure can proceed as follows:

  1. Recording of Notice of Sale: A notice of sale, containing essential information such as borrower’s and lender’s names, original loan amount, current default amount, mortgage date, property description, and the date, time, and place of the foreclosure sale, must be recorded in the county where the property is located.
  1. Conducting the Sale: The county sheriff, responsible for the location of the property, conducts the sale on the date specified in the notice of sale. During the sale, the sheriff presents an itemized statement, filed by the lender, detailing the amount due at the time of the sale. The property is sold to the highest bidder, and the winning bidder receives a certificate of sale.
  1. Deficiency Judgment and Redemption: Lenders have the option to pursue a deficiency judgment, limited to the fair market value of the property and the unpaid balance of the original loan. Borrowers have a redemption period of up to one (1) year to reclaim the property by paying the past due amount on the loan.
