Texas State Auction Process

Texas is a redeemable tax deed state,  meaning that tax liens are not sold but rather tax deeds are auctioned off to collect delinquent taxes. Unlike some other states, Texas does not offer tax lien sales. Instead, tax deeds are issued, granting the county the authority to sell the property at auction to recover the unpaid taxes.

 In Texas, auctions are generally held on the first Tuesday of each month between 10:00 a.m. and 4:00 p.m. at the county courthouse. Some auctions are held online. The sale must begin at the time stated in the notice of sale, but no later than three hours after the time scheduled on the notice of sale.

Tax deed sales in Texas are typically conducted through auctions. The redemption period for non-homestead, non-agricultural, and non-mineral rights real estate is 6 months, while for homestead, agricultural, and mineral rights real estate (HAM), the redemption period extends to 2 years. During this redemption period, the original property owner has the opportunity to repurchase the property by paying the outstanding taxes, penalties, and interest.

If the original property owner fails to redeem the property within the specified time frame, the investor can obtain a clear title to the property. This presents a lucrative opportunity as investors can potentially earn significant profits, with returns of up to 25% per year, within a short period, whether it’s a few days or a few months.

While there is a redemption period in Texas, investors can still benefit from the tax auction process. It’s important to note that while investing in Texas tax deeds can be financially rewarding, there are risks involved. The original property owner has the right to redeem the property, which means the investor may not ultimately acquire the property. Foreclosure in Texas

In Texas, lenders may foreclose on deeds of trust or mortgages in default using either a judicial or non-judicial foreclosure process.

Judicial Foreclosure

The judicial process of foreclosure, which involves filing a lawsuit to obtain a court order to foreclose, is used when no power of sale is present in the mortgage or deed of trust. Generally, after the court declares a foreclosure, the property will be auctioned off to the highest bidder.

Non-Judicial Foreclosure

The non-judicial foreclosure process is used when a power of sale clause exists in a mortgage or deed of trust. A “power of sale” clause is the clause in a deed of trust or mortgage, in which the borrower pre-authorizes the sale of property to pay off the balance on a loan in the event of their default. In deeds of trust or mortgages where a power of sale exists, the power given to the lender to sell the property may be executed by the lender or their representative, typically referred to as the trustee. Regulations for this type of foreclosure process are outlined below in the “Power of Sale Foreclosure Guidelines”.

The Texas Foreclosure Process in 3 Steps

In Texas, non-judicial foreclosure is the most common process used. Here, we outline the steps involved in this foreclosure process to provide a clear understanding:

Step 1: Notice of Default and Intent to Accelerate

Under Texas law, the lender or servicer must send the borrower a notice of default and intent to accelerate via certified mail. This notice gives the borrower a minimum of 20 days to rectify the default before the notice of sale can be issued. The notice should include the amount due and the deadline for payment. In some cases, a breach letter sent as per the deed of trust terms can satisfy this requirement.

Step 2: Notice of Sale

Once the cure period has passed, and at least 21 days before the foreclosure sale, the lender or servicer sends a notice of sale to all borrowers obligated to repay the debt. This notice is sent via regular and certified mail and is also posted at the county courthouse where the property is located. Additionally, it is filed with the county clerk. The notice of sale includes details such as the sale date, time, location, and disclosure for military service members to indicate their military status.

Step 3: The Foreclosure Sale

Foreclosure sales in Texas take place on the first Tuesday of each month, typically between 10:00 a.m. and 4:00 p.m. These sales are commonly held at the county courthouse, although the notice of sale may specify an alternative location. The auction begins no later than three hours after the scheduled time mentioned in the notice. At the sale, the property is sold to the highest bidder, which can be a third party or the foreclosing lender.

While Texas has robust homestead protection laws, it’s important to note that there is no guaranteed right to undo or redeem a property after a mortgage foreclosure. Once the foreclosure sale takes place, ownership of the property transfers to the winning bidder or foreclosing lender.

Power of Sale Foreclosure Guidelines

If the deed of trust or mortgage contains a power of sale clause and specifies the time, place, and terms of sale, then the specified procedure must be followed. Otherwise, the non-judicial power of sale foreclosure is carried out as follows:

  1. Prior to proceeding with a foreclosure, Texas laws state that the lender must mail the borrower a letter of demand, informing the buyer he has twenty (20) days to pay the delinquent payments or foreclosure proceedings will begin.
  2. At some point, after the borrower’s twenty (20) days have expired, but at least twenty one (21) days before the foreclosure sale, a foreclosure notice must be: 1) filed with the county clerk; 2) mailed to the borrower at their last known address; and 3) posted on the county courthouse door.
  3. The foreclosure sale must take place on the first Tuesday of any month, even if said Tuesday falls on a legal holiday, but only after the proper preliminary notices have been given. The sale is on the courthouse steps by auction to the highest bidder for cash. Anyone may bid, including the lender, who bids by cancelling out the balance due on the note, or some part of it.

Lenders may obtain deficiency judgments, but they are limited to the difference between the fair market value of the property at the time of sale and the balance of the loan in default.

  4. Relatively quick foreclosure process: The foreclosure process in Texas is generally quick, typically taking around 6 months from the initial default to the foreclosure sale. This timeline may vary depending on various factors and circumstances.
  5. Elimination of junior liens: Non-judicial foreclosure in Texas has the effect of cutting off and eliminating junior liens, including mechanic’s liens, except for any liens for unpaid taxes.
